Welcome to Fluxing LLC ("Fluxing", "we", "our", or "the Company"), a company incorporated in Wyoming, United States. By accessing or using our services, website and CRM-based automation tools, you agree to be legally bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

1. Acceptance of Terms

By creating an account or using any Fluxing service, you confirm that you have read, understood and accept these Terms and Conditions. If you are acting on behalf of a company or organization, you warrant that you have the authority to bind that entity.

2. Description of Service

Fluxing provides CRM automation services and tools, including setup, configuration and ongoing support for sales and communication processes. Services include, without limitation:

• CRM with contact management and sales pipelines
• Messaging and follow-up automations
• Unified multichannel inbox (WhatsApp, Instagram, Facebook, email)
• Landing pages and lead capture forms
• Automatic appointment scheduling
• Analytics and performance reports

Services may include subscription-based access, one-time setup fees and optional support plans.

3. Registration and Account

To access the services, you must register and create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree to use the services only for lawful purposes and in accordance with these terms. The following are expressly prohibited:

• Using the platform to send spam or unsolicited communications
• Violating any applicable law or regulation
• Attempting unauthorized access to third-party systems or data
• Using the services for fraudulent or deceptive activities
• Reselling or sublicensing the services without express authorization

5. Subscriptions and Payments

Some Fluxing services require a subscription payment. Pricing and terms are provided during the onboarding or subscription process. Payments are non-refundable except as stated in our refund policy. Payments are processed securely through third-party providers such as Stripe. We do not store full credit card information on our servers. We reserve the right to modify prices with 30 days' prior notice.

6. Free Trial Period

We offer a 15-day free trial with no cost and no credit card required. At the end of the trial period, you must subscribe to a paid plan to continue using the services.

7. Intellectual Property

All rights, title and interest in the Fluxing platform, including software, design, trademarks and content, are the exclusive property of Fluxing and its licensors. These terms do not grant you any ownership rights in the services.

8. Privacy and Data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. By using the services, you consent to the processing of your data in accordance with that policy.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fluxing shall not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the event that gave rise to the claim.

10. Termination

We may suspend or terminate your access to the services at any time if you violate these terms, with or without prior notice. You may cancel your account at any time. Upon termination, provisions that by their nature should survive will remain in effect.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on the platform. Your continued use of the services after notification constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
